GOLF CART / MOTORPOOL RULES & REGULATIONS, WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK & COVENANT NOT TO SUE

THIS DOCUMENT MUST BE CAREFULLY READ AND SIGNED IN CONSIDERATION OF BEING PERMITTED TO USE EQUIPMENT (DEFINED BELOW), INCLUDING GOLF CARTS, IN CONNECTION WITH THE EVENT. THIS DOCUMENT APPLIES TO USE OF EQUIPMENT BEFORE, DURING AND/OR AFTER THE EVENT DATES SET FORTH ABOVE AS WELL AS USE OF SUCH EQUIPMENT IN ANY LOCATION (WHETHER ON-SITE OR OFF-SITE). PRODUCER’S FAILURE TO ENFORCE ANY RULE OR REGULATION HEREIN DOES NOT CONSTITUTE A WAIVER OF ANY PROVISION OF THIS AGREEMENT.
RULES & REGULATIONS
- Use. Any equipment rented from Producer, including (without limitation) carts, gators, lifts, radios and generators (collectively, “Equipment”) shall be used solely in connection with work performed by you in connection with the Event.
- Failure to Use Requested Equipment. The cost of any dedicated Equipment that you or your employer request for the Event but do not use shall be passed through to you or your employer at the conclusion of the Event.
- Operation of Equipment. You represent and warrant that you are qualified and properly trained to operate the Equipment, shall not operate any Equipment if you are intoxicated, under the influence of drugs or taking prescription medication that interferes with your job performance and shall operate Equipment in a safe manner and for the purpose(s) for which Equipment is intended to be used. Failure to operate Equipment in accordance with these rules and regulations will result in the loss of driving privileges (if applicable), disciplinary action and potential ejection from the Event. As it pertains specifically to golf carts:
- All drivers must be approved in advance and have a valid driver’s license issued by the state of his or her residence;
- Carts must have a proper cart pass to enter into prohibited areas, including certain backstage areas; and
- At the end of each workday, you must (a) lock your cart in a safe area, (b) make sure your cart is not obstructing any road or pathway, (c) check your fuel levels and (d) remove all personal belongings and trash from the cart
- Damage to Equipment. You or your employer will be responsible for any damage to Equipment incurred while you are using the Equipment or it is checked out to you, including the cost to replace or repair the Equipment.
- Loss of Equipment. Loss of Equipment will result in the cost to replace the Equipment. In addition, Producer shall not be responsible for any fees or costs incurred by you or your employer for lost or stolen Equipment.
IMPROPER BEHAVIOR
- Clean Workspace. If workspace garbage is not removed upon Event completion, you or your employer will be charged the cost of cleanup.
- Credential Abuse. If you abuse credential access privileges (e.g., using an all-access staff credential to watch a show or enjoy the VIP area benefits), your credentials will be revoked and you may be ejected from the Event.
- Driving Recklessly. Any driver who is drinking alcohol or visibly under the influence of drugs and/or alcohol, using a cell phone while driving, speeding or acting recklessly or negligently, driving with no headlight after dusk, failure to report an accident, driving in prohibited areas, driving passengers with alcohol, exceeding cart capacity, driving people who are standing, driving without a license, leaving the cart unlocked, vandalizing the cart, tampering with cart engine and/or disobeying any cart rules RISKS LOSING ALL DRIVING PRIVILEGES, even first time offenders, as well as disciplinary action and/or ejection from the Event.
REMEMBER:
- No driving under the influence of drugs or alcohol
- No open containers while driving
- No talking or texting while driving
- No reckless driving
- No excess passengers (one person per seat)
- No rides to ticketed patrons, unless required by on-site responsibility
- No passengers in the bed of a cart
- No towing
- No tampering with the cart engine
- No standing while driving
- All traffic signs must be obeyed.
- All accidents must be reported.
- Maintain safe driving speeds (5 miles per hour or less) around the Event site at all times.
WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK AND COVENANT NOT TO SUE
• I recognize and acknowledge that there are hazards and risks of physical injury from using the Equipment and that not all such hazards or risks can be fully eliminated. I freely and voluntarily agree to assume the full risk of death, bodily injury or property damage, regardless of severity, that I may sustain the Event, including from my use of any Equipment.
• I agree to indemnify and hold harmless the Producer, premises owner, management, promoters, attendees, artists, sponsors and partners and their respective affiliated companies, officers, directors, members, managers, employees, representatives, successors and assigns (collectively, “Releasees”) from and against all suits, actions, legal proceedings, claims, demands, damages, judgments, liabilities, interest, attorneys’ fees, costs and expenses of whatever kind or nature (collectively, “Claims”) directly or indirectly caused by my acts or omissions at the Event, including my use of any Equipment.
• I release, waive and discharge (and covenant not to sue) the Releasees from all liability to me, my personal representatives, assigns, heirs and next of kin, for any Claims, whether direct or indirect, in law or in equity, in contract or in tort, or otherwise, whether known or unknown, arising out of or connected with my acts or omissions at the Event, including my use of any Equipment.
BY SIGNING BELOW, I ACKNOWLEDGE, AGREE AND REPRESENT THAT I HAVE CAREFULLY READ AND FULLY UNDERSTOOD THIS DOCUMENT AND AGREED TO ITS TERMS.
